Our LCAP was approved by the Board of trustees in July and is currently being reviewed by the County. It will be posted to our website in final form as soon as that process is complete.
Due to a controversial court ruling in the Morgan Hill Case, (a lawsuit between disability advocacy groups and the California Department of Education – CDE) and the fact that CDE is being compelled to provide data to the court, including student information, this notice is intended to ensure that parents are made aware that this information is being released to the court.
While the information will not be released publicly, the CDE Special Education Division is required by FERPA to inform parents of the court’s action. Generally, parents and/or students must provide written consent before an educational agency may disclose pupil information. However, there are exceptions to this general rule. Specifically, an educational agency must provide pupil information when ordered by a court, which CDE has been ordered to do in this litigation.
Also, given that this is an action taken by the court, CDE and Dunsmuir High School is not able to provide additional information or answer questions about this issue. Parents may contact the court to object to this issue if they wish.
Here is the link to the CDE site to obtain more information and a form to submit objecting to the disclosure of student information and records. This form must be submitted to the Court by April 1, 2016.
